What this tool calculates

French statutory severance pay is due after 8 months of continuous service, except in cases of serious misconduct. It amounts to a quarter of a month’s salary per year of service up to ten years, and a third of a month per year beyond that; an incomplete year counts pro rata to the number of full months (articles R1234-1 and R1234-2 of the Labour Code).

The reference salary is whichever formula favours the employee: the average of the last twelve months of gross pay, or the average of the last three months — annual bonuses only count for one twelfth per month (article R1234-4). The tool compares both and states which one was used.

What is not modelled

This is the statutory minimum. A collective agreement, contract or established practice may provide a higher amount: the most favourable applies. Check your collective agreement before any decision.

Outside the calculation: the special severance for work-related incapacity (doubled, article L1226-14), careers mixing part-time and full-time work, ongoing sick leave (the reference salary is then taken from the months preceding the leave) and the tax and social treatment of the payment.
